Banking

• Advising and representing a foreign based UHNWI in the context of data stolen by an employee of a Swiss based bank (questions of international judicial assistance, ultimate beneficial ownership, potential claims against the bank in case of unauthorized forwarding of the data to foreign authorities).
• Advising of a mid-sized Swiss private bank in the context of potential violations of U.S. tax laws. Supporting the U.S. law firm representing the client before U.S. authorities and in U.S. courts as to matters of Swiss law.
• Drafting of an expert opinion on behalf of a government agency of an EU Member State regarding the scope and applicability of Swiss banking secrecy rules. Acting as an expert witness (Martin Waldburger) in related court proceedings.
